These Terms and Conditions (“Terms”) govern your access to and use of all services provided by New Song Fellowship Church (“NSFC,” “we,” “our,” or “us”), including but not limited to: our website at newsongtn.cc; our church management and member portal; email communications; SMS/text messages; online donation services through Tithely; sermon videos and livestreams on YouTube; embedded maps and media; our attendance system; photo galleries; our monthly newsletter; and our social media channels. Collectively, these are referred to as our “Services.” By accessing or using any of our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please discontinue your use of our Services.
We may update these Terms from time to time. Your continued use of our Services after any changes constitutes your acceptance of the updated Terms.
2. Description of Services
NSFC provides digital services to support its mission of being and making disciples of Jesus Christ. Our Services include, but are not limited to:
- A public website providing information about our church, services, events, and ministries.
- Online sermon archives with video content hosted on YouTube.
- Online donation capabilities through our third-party payment processor, Tithely.
- Email and SMS communications regarding church news, events, and ministry updates.
- A monthly newsletter for active participants.
- Photo galleries documenting church life and events.
- Livestreaming and recording of worship services.
- An attendance check-in system for services and events.
- A church management portal for authorized administrators.
Services are provided on an “as is” basis and may be modified, suspended, or discontinued at any time without prior notice.
3. Eligibility and Age Requirements
Our website and public services are available to individuals of all ages. However:
- Access to administrative accounts and the church management portal requires you to be at least 18 years of age or to have the consent of a parent or legal guardian.
- Participation in children's ministry programs requires parental or guardian registration and consent.
- Online donations should be made by individuals who are at least 18 years of age or have parental authorization.
4. User Accounts and Authentication
Certain features of our Services, such as the church management portal, require an authorized user account. If you are provided with account credentials:
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to notify the church immediately if you become aware of any unauthorized use of your account.
- You are responsible for all activity that occurs under your account.
- NSFC reserves the right to suspend or terminate accounts at any time for any reason, including violation of these Terms.
5. User Conduct
When using our Services, you agree to:
- Use our Services only for lawful purposes.
- Not interfere with or disrupt the operation of our Services or the servers and networks that host them.
- Not attempt to gain unauthorized access to any part of our Services, accounts, or systems.
- Not use our Services for commercial solicitation or advertising without prior written permission.
- Treat fellow church members, staff, and volunteers with respect in all interactions facilitated through our Services.
6. Intellectual Property and Copyright
All content on our website and within our Services, including but not limited to text, graphics, logos, photographs, sermon recordings, videos, and audio content, is the property of New Song Fellowship Church or is used with permission, and is protected by applicable copyright and intellectual property laws.
- Sermon content may be shared for personal, non-commercial use with proper attribution to New Song Fellowship Church.
- Reproduction, distribution, or commercial use of our content without prior written permission is prohibited.
- The NSFC name, logo, and branding elements are protected and may not be used without authorization.
- Music used in our services may be covered under CCLI licensing and is subject to the terms of those licenses.
7. Online Giving and Donations
Online donations are processed through Tithely, a third-party payment platform. By making an online donation:
- You agree to Tithely's Terms of Service and Privacy Policy.
- All donations are voluntary and are generally non-refundable. If you believe a donation was made in error, please contact us at admin@newsongtn.cc promptly.
- Tax receipts are provided in accordance with IRS guidelines for charitable contributions to 501(c)(3) organizations.
- NSFC does not store your payment card or bank account information.
8. Media Content, Livestreaming, and Recordings
Worship services and church events may be recorded, photographed, and livestreamed. By attending our services or events:
- You acknowledge that you may appear in photographs, videos, or livestreams that may be shared on our website, YouTube channel, Facebook page, or other platforms.
- Recordings of sermons and services are made available for personal spiritual growth and edification.
- If you wish to avoid being recorded, please notify a staff member or usher before the service.
- Requests to remove specific images or videos can be submitted to admin@newsongtn.cc.
9. Email and SMS Communications
By providing your email address or phone number, you may receive communications from NSFC regarding church events, news, newsletters, and ministry updates. Our communications practices are governed by our Privacy Policy, which includes detailed information about:
- How we obtain consent for email and SMS communications.
- How to opt out of communications at any time.
- Our compliance with the CAN-SPAM Act (email) and the Telephone Consumer Protection Act (SMS).
- That standard message and data rates may apply for text messages.
- That consent to receive communications is not a condition of church membership or participation.
10. Third-Party Links and Services
Our Services may contain links to or integrations with third-party websites and services, including but not limited to:
- Tithely for online donations
- YouTube for sermon videos and livestreams
- Facebook for social media and community engagement
- Google Maps for location and directions
NSFC is not responsible for the content, privacy practices, or terms of service of any third-party websites or services. The inclusion of a link does not imply endorsement. We encourage you to review the terms and privacy policies of any third-party services you use.
11. Disclaimer of Warranties
Our Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.
- We do not warrant that our Services will be uninterrupted, error-free, or free of viruses or other harmful components.
- We do not warrant the accuracy, completeness, or reliability of any content on our website.
- Spiritual guidance, sermons, and pastoral counsel provided through our Services are offered in a religious context and do not constitute professional counseling, legal, medical, or financial advice.
NSFC is a nonprofit religious organization and provides its Services in furtherance of its religious mission.
12. Limitation of Liability
To the fullest extent permitted by applicable law:
- NSFC, its pastor, staff, volunteers, and board members shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services.
- Our total liability for any claims arising from these Terms or your use of our Services shall not exceed the total amount you have paid to NSFC, if any, in the twelve (12) months preceding the claim.
- We are not liable for any loss or damage resulting from third-party services, including payment processing errors by Tithely or service interruptions by our hosting providers.
13. Indemnification
You agree to indemnify, defend, and hold harmless New Song Fellowship Church, its pastor, staff, volunteers, and board members from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to:
- Your use of our Services.
- Your violation of these Terms.
- Your violation of any rights of any third party.
- Any content you submit or transmit through our Services.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.
In the event of any dispute arising from these Terms or your use of our Services:
- Good-Faith Discussion: The parties shall first attempt to resolve the dispute through good-faith discussion with church leadership.
- Mediation: If the dispute cannot be resolved through discussion, the parties agree to submit the dispute to mediation in Hawkins County, Tennessee.
- Litigation: If mediation is unsuccessful, any litigation shall be brought exclusively in the courts of Hawkins County, Tennessee or the United States District Court for the Eastern District of Tennessee.
15. Modifications to Terms
NSFC reserves the right to modify these Terms at any time. When changes are made:
- The updated Terms will be posted on this page with a new “Effective Date” and “Last Updated” date.
- Material changes may be communicated through our website or via email.
- Your continued use of our Services after any changes constitutes your acceptance of the updated Terms.
We encourage you to review these Terms periodically to stay informed of any updates.
